distract people from the real issues." why is the rodriguez team not being as strong in coming out and saying look, he did not use performance-enhancing drugs? >> you understand for some of the lawyers where, we're in the midst of some of the best lawyers in new york city. >> as an attorney you know it's a very simple statement my client did not use performan performance-enhancing drugs. >> because there is a confidentiality clause. >> there is while he appeals his 211-game suspension. in a letter to tacopina major league baseball says tacopina is free speak about rodriguez' alleged p.e.d. issues, it says it has evidence he used them provided by the former anti-aging clinic biogenesis. can you tell us what

there continues. cnn chief national correspondent john king is here to break it all down for us. so john, we're talking reprog m reprogrammireprogra reprogramming funds. the administration is putting a hold on aid to egypt without having to say it, like they're acting like it's a coup without having to make the significant declaration. what's the effect here do you think? >> what they're trying to do here, kate, i've just been having an e-mail exchange with a couple administration officials is to split the difference. inside the administration they're disappointed, outraged at the steps the egyptian military has taken, heard from senator john mccain stop, the united states cannot continue to walk with these guys. the administration instead of saying fine we'll pull the plug on the aid, we'll turn the corner on this relationship they say we're going to hit the pause button. you're not getting the money now. we're sending you a stern signal. they're hoping in the white house or state department in a week or two they can say things

have calmed down. let's have conversations about how we move forward. punishment but they're hoping not a full break, a turn in the relationship. >> at the same time new poll numbers from the pew research center suggesting a majority of americans, 51% say congress should pull foreign aid to egypt, despite the fact that few americans are following the situation very closely. only 22% are really following the situation closely. it makes me wonder what that should tell us and does that inform how the administration moves forward and how they make decisions here? >> a president, any president will always tell you he makes big national security decisions based on the facts and the interests of the united states government and sometimes you have to go against public opinion. there's no question the american people are tired of foreign aid. they think more resources should be spent at home and you see that don't know part. people were optimistic in the first wave of the arab spring. you look back and think where are we going? a lot more question marks than

optimism that you had initially. the american people are skeptical and they don't want a huge military investment in the middle east, not necessarily just egypt but anywhere there. those who are watching the pictures and reading the stories are certainly outraged by what they are seeing. does it put some pressure on the administration yes, but these decisions are mostly made in the quiet of the situation room and the oval office. >> before i let you go i've got your take on ted cruz. he's ready to renounce any canadian citizenship, if he had it. he was born in canada to an american mother and a cuban father. i feel like we need a family tree or some diagram to ofollow this. the fact he went as far to send out his birth certificate to the media, i mean, what does that tell you? claims like this, even unfounded this simmering question are

there presidential aspirations? is it that much of a liability if anyone talks about the issue? >> ted cruz is operating on the birther playbook he saw used against president obama in 2008 and some again in 2012. the senator was just elected in texas but he's making moves and noise and may sink the republican presidential nomination. his mother was an american born citizen, he was in canada when he was born. most look at this, case closed he's eligible to run for president. because of canadian law because he was born in canada he is a citizen. senator cruz said he didn't know that and he says no offense to canada he's going to do the paperwork necessary to renounce that citizenship. is that necessary? of course not. could he run for president with dual citizenship, most of the experts say yes. this is capital "p" politics. it would be silly season if it happens again but this is the senator's decision to clear up

the canada part and trust me some people will still raise the eligibility part. >> you used a lot of air quotes in today's political gut check. john, great to see you. >> air quotes means b.s. kate and i were looking online before the show. you don't have to be born in the united states to be naturalized and eligible for president. lot of people didn't know that including two thumbs pointing at this guy guy, if you have one or both parents u.s. citizens, you can be born anywhere, you're still eligible. that's what the constitution says so not an issue. it makes for political culture. we saw what happened with the president whether or not he was a citizen but sad commentary about the state of politics somebody feels by renouncing citizenship in canada. >> it's silly season. >> silly is a nice word though, like when you're mad at your kids, that was really silly what you did! it means something else. coming up on "new day" he

the man who helped expose the nsa secrets isn't done. he said he's going to release more documents. what does very? this man could be the largest person alive. he can't move on his own and until now hadn't left his bed in two years but why are we telling this? help is on the way. the king of saudi arabia is bringing that help. we're going to tell you this amazing story. an upsetting story two day care workers fired for allegedly posting cruel pictures on instagram making fun of the children they're supposed to be taking care of. we'll speak live with one mother who says one of the pictures mocked her son who has a delayed speech development. first, breaking overnight an airtran flight forced to make an emergency landing in memphis, tennessee. the plane was traveling from baltimore to austin, texas, when officials say a passenger tried to open an emergency exit mid flight. cnn's christine romans is following the developments for

us. >> a lot of questions about the motive behind this man who walked to the back of the airplane and tried to open this door. 120 passengers on board, five crew members at about 7:07 our review shows this plane turned around and started heading to memphis where it landed. the fbi took this passenger, affiliate wreg reporting the fbi detained him and the plane went on to's tib where everyone deplaned and they were okay. the motive of this man still a big question here. southwest airlines official telling wreg said the man appeared unruly. just fyi, you can't open the plane mid flight. >> are you sure about that? >> it's very difficult. look, it is very terrifying for the people on board when you have somebody trying to disrupt a flight. >> the obvious question we keep

using the word motive, was this a directed act or was this somebody who is unstable. that's the key distinction so we have to find out. >> it doesn't matter. it was terrifying regardless. >> 120 passengers on board, five crew members, landed last night safe in austin. >> a hefty delay trying to get to austin last night i'm sure. >> thanks. this map tells the tale, 49 separate wildfires in 11 different states, in central idaho the beaver creek fire consumed more than 100,000 acres, placing thousands of homes at risk in the sun valley resort area. cnn's dab sidan simon is live i idaho tracking all of this. good morning. >> reporter: as you can imagine with more than 100,000 acres burned crews are using every resource imaginable to get this fire under control. it's just 9% contained at this point, with plenty of areas left to burn.

fire continuing to ravage one of the country's most scenic spots. drive through the mountains and you can understand why many celebrities like tom hanks, arnold schwarzenegger and bruce willis choose this area to build multimillion-dollar vacation homes and why some insurance companies call in their own firefighters to help prevent a calamity. but as a red cross official told me -- >> there are many people affected from different socioeconomic backgrounds. and that's who is staying with us. >> reporter: staying in a shelter like this high school where we met orlanda cabrito. >> i think not knowing the outcome, if we're going to be able to go home, if we're going to have a home. i think that's the most nerve-racking. >> reporter: the beaver creek fire is a true beast spreading across an area larger than the city of denver, surrounded by bone dry trees and brush this

fire could keep burning for a long time. the key is to keep the flames away from homes, but the wind has a way of pushing the fire in different directions. >> we have plenty of resources right now, and it's just a matter of having people in the right place at the right time, which i believe we do at this point in time. it's just a lot of work to go ahead and get this thing contained. >> reporter: well at this point the fire is not immediately threatening homes so that's why hundreds of residents were allowed to go back to their houses last night and rain is supposed to be in the forecast perhaps as early as this evening, chris, but with rain you have the possibility of thunderstorms and lightning and there's a concern that could produce even more fires. chris? >> all right, dan, thank you very much. on the other side of the country the problem is rain and way too much of it, from florida, the carolinas, there's more rain in the forecast, that means flooding in areas already saturated. indra petersons is tracking all of this severe weather.

what do we know this morning? i don't like the picture behind you. >> we say rain day after day. it's hard to say week after week. at this point month after month. look at the flooding, this is georgia where the fair road apartments got flooded, furniture was rolling around in the high waters. i want you to look at the map. after heavy rain and record-breaking rain from just june look at all of the flood warnings. where you see some of the lighter green that means flooding is already eminent and flood watches again, all of this stretching from florida into the carolinas and unfortunately we're not looking at good news as it's expected to get worse with more rain in the forecast. they've had anywhere from 20 to 30 inches of rain just since june. let's talk about the surplus. you do get some rain in the summer in the southeast but this is the surplus. they're not supposed to get this much, 15 inches over average, now what we saw yesterday notice the same places seeing rain.

let's talk about what we're looking for as we go forward in time, today, stationary front will still be in place again, anywhere from the southeast into the carolinas there, and we go into tomorrow, the same picture, i can take you out thursday, we can keep doing this day after day because it's not going to change. i can put the same picture up every single day. >> needing something to move that along. thanks so much, indra. if the nsa spying scandal hasn't been explosive enough, reporter glen greenwald from "the guardian" newspaper has published thousands of secret documents he received from edward snowden. now he's vowing to be more aggressive after british authorities detained his partner for questioning at heath row airport. jill dougherty is live from washington tracking the latest developments. good morning. >> hey, kate. this detention of greenwald's partner is stirring up a storm, greenwald saying the british government is acting worse than the mafia. officials indicating there was reason to stop david miranda.

at the airport in rio de janeiro, glen greenwald, the report who broke the news about nsa leaker edward snowden hugged his partner, david miranda and angrily told reporters british authorities are going to regret what they did. "i'm going to write my stories a lot more aggressively than before" he said. "i'm going to publish many more documents now. i have a lot of documents about the espionage system in england." miranda said british agents citing an anti-terrorism law detained him at heath row airport for nine hours. he was on his way back to rio from berlin where he met with u.s. filmmaker laura poitress. she's worked with greenwald and snowden on stories about nsa surveillance. "they took my computer, video games, cell phone, everything," he said. the white house claims it did not ask britain to stop miranda,

but -- >> there was a heads up that was provided by the british government, so this is something that we had an indication was likely to occur but it's not something that we requested and it's something that was done specifically by the british law enforcement agents there. >> reporter: u.s. officials won't say whether they've got their hands on miranda's computer but the state department notes -- >> we do have a close law enforcement and intelligence relationship with the uk. >> reporter: neither the state department nor the white house is condemning miranda's detention, an indirect way of saying they think it's justified. greenwald meanwhile calls the detention of his partner a profound escalation of the government's attacks on the news gathering process and on journalism but the uk police are calling it legally and procedurally sound. chris? >> jill, thank you very much for the reporting. let's figure this out analytically. joining me is cnn's senior legal

analyst jeffrey toobin. >> good morning. >> always great to have you here. first question, is this payback/targeting, in your opinion? >> hard to tell, but it's important to point out, he was not just some tourist passing through. he was working with greenwald, his ticket was paid for by "the guardian" he was meeting with greenwald's partner, the filmmaker, and bringing documents and computer material back to greenwald, so it's not like they just sort of randomly harassed him. is he involved in this activity so i -- you can see why the british government wanted to get its hands on this material. >> allow for everything you see, does that make this okay, does it make it legal? does it go too far still? >> it's hard to say. remember this is great britain. great britain has tougher laws about secrets and secrecy than we do. they don't have the same freedom of the press. similar but not identical, and even more bizarre incident that

i think is totally indefensible that took place yesterday is that british agents went into "the guardian" newspaper and actually destroyed some computers because they thought there was some secret material on it. it was a futile, stupid harassment. i think that's indefensible. stopping and getting this material i think is a closer call. >> we go to the reaction, why is the u.s. involved in this? we didn't stop them. why are they making statements about this? why is greenwald implicating the u.s. in this? >> let me lay my cards on the table. i've been critical of greenwald throughout this process and the idea he's now engaged in revenge journalism that he says he's going to disclose more material because they stopped his partner, that's not how we're supposed to act. we're journalists because there's material to be published, not because we're angry at people. i'm not sure what happens now. presumably greenwald has the material and he's going to put it out there. >> the u.s. didn't do this.

>> that's right. we do have a close relationship as the white house spokesman said, but we didn't destroy the british newspaper's computers, we didn't stop him. i'm sure we were happy that he was and i'm sure that we will learn what was on that computer material, but this was a british operation, non-american one. >> it seems to add to the stink of this situation. the early criticism of snowden, if you wanted to be a patriot and put out information, go to the whistle-blower places, go to the media here in the u.s., do what you have to. he said i tried t didn't work but that was early criticism. now we have greenwald saying i don't like what did you to my partner. i am going to report more aggressively and put out more documents. what does that suggest about the situation? >> it's horrible. there are lots of journalists who have been very supportive of snowden and greenwald. i'm not. i don't think this is how the system is supposed to work. i think snowden is not a

patriot. i think he has done grave damage to the united states. i think there are thousands of people in this country who work hard to protect classified information, who are trying to do a decent job and the idea that he, on his own, could do this, and -- is just appalling to me and the fact that he brought this stuff to china and russia, two of the most repressive dictatorships in the world, is really totally disgraceful. >> another message to snowden, this is probably another reason he won't want to come back to the u.s., if this is the type of -- >> he's got a long list of those reasons. i think he's going to develop a taste for borscht and spend quite a few years in russia. >> maybe he'll get a ride on the crazy crane that drags you through the water. jeffrey toobin thank you. >> good to see you. let's move on to a case that captivated a country. after more than two weeks and 80

witnesses, the court-martial of major nidal hasan, he could be getting ready to take the stand and remember he's representing himself in this court-martial. cnn's ed lavandera is in ft. hood, texas, with more. >> reporter: good morning, kate that, caveat representing himself leaves a lot of questions of just exactly what will nidal hasan's defense look like when it possibly starts later today. almost four years after the ft. hood massacre, nidal hasan will be center stage, expected to try to justify why he killed 13 unarmed fellow soldiers and wounded more than 30 others. >> there's no telling what he's going to do when he gets on the stand, if he testifies, which i suspect he will, to tell his story which essentially admits to the fundamental crimes and then gives an excuse for doing so. >> reporter: for the victim's family, hasan's testimony could

prove to be a painful side show, hasan, who is an army psychiatrist has not been told he cannot argue he killed american soldiers because in his view they were preparing to fight muslims in afghanistan and iraq. since he's acting out his own attorney he'll ask a series of questions for his standby attorneys to ask him. >> a defendant i believe has the right to, we know he has the right to represent himself and he has the right to do it poorly, and i think he has the right to ask for capital punishment. >> reporter: which leaves shooting survivors like christopher royal anxious for hasan to go away. >> i won't allow him to consume any more energy from my life that he's already done, and so i have released him. i've forgiven him completely, and it's not up to me to punish him.

to cover as well. random and senseless act of violence has left a promising 22-year-old baseball player dead. family devastated and two countries across the world rattled. christopher lane was gunned down allegedly by three teenagers while he was out jogging. new details reveal the suspects' chilling motive as well. they say they just wanted to kill someone. shock and grief spread across two continents over the death of christopher lane. the 22-year-old from melbourne, australia, was in the u.s. attending oklahoma's east central university on a baseball sk scholarship in the typically quiet town of duncan, oklahoma, three teenagers allegedly shot lane in the back for fun and sped away in their car. >> there was people that saw him stagger across the road, go to a kneeling position and collapse on the side of the road.

>> reporter: nearly 10,000 miles away where the shoot something making front page news lane's family is struggling to cope with what happened? >> there's not going to be good ahead of this because it was just so senseless. it's happened. it's wrong. and we just try and deal with it the best we can. >> reporter: three teenagers just 15, 16 and 17 years old arrested and expected to be charged with first-degree murder, in an interview with an australian radio station the police chief revealed the teen's shocking motive. >> just they decided all three of them were going to kill somebody. >> somebody, anybody. >> wow. >> reporter: lane's girlfriend, sarah harper posted an emotional tribute on facebook saying in part "you will always be mine and in a very special and protected place in my heart." police also say the three suspects had plans to carry out a second killing that exact same night but they were caught and

texas diverted to memphis as a passenger tried to open up the door in flight. the fbi detained that suspect for two hours once the plane landed in memphis. he was later taken away in a police cruiser. close to 50 wildfires burning in 11 states but there is a possible break for firefighters in central idaho, an aerial assault along with several thousand firefighters on the ground helping to turn the tide on the beaver creek fire. more relief expected today in the form of wet weather. to the west, most of the people who live in the small town of atlanta, idaho, defied evacuation orders to help fight the 8,000 acre little queens fire. the u.s. freezing some military aid to egypt, the obama administration is reprogramming aid while it decides the best approach to the situation there. also egypt's muslim brotherhood has picked mahmoud azat as its new temporary spiritual leader after their leader was arrested for allegedly inciting violence.

james dimaggio, the man who abducted hannah anderson after killing her mother and brother left an insurance policy naming her grandmother as beneficiary. he wanted the money to go to hannah and ethan but thought the parents' relationship was too unstable to leave the money with them. incredible pictures from russia, rescue crews had to rescue two brown peabears, that them in the cage. the flooding is the result of torrential rains that forced some 20,000 residents from their homes. and a little something to make you smile on this tuesday. she may be very little but that doesn't mean she can't help out with the chores, cleaning windows. it is an interesting approach. i'm thinking it will take her a lot of time. we might give her a squeegee for christmas. look at the face and the bow in

welcome back, everybody. this morning there are disturbing allegations against two virginia day care workers fired for allegedly mocking the children they were supposed to be caring for. one woman reportedly posted pictures of a kid on instagram and made fun of him. look at the background of the story. ethan jordan is a happy,

energetic 2-year-old but here he is sitting in a highchair which he no longer uses his usual smile replaced by a frown and his mother is heartbroke been it, that's because workers at heavenly haven learning center two placed had imin the chair and posted this picture to instagram purely to make fun of him. the day care center's manager joined in poking fun at ethan's delayed speech development writing in part "thinking, cuz sure can't talk." in another incident the employee mocked another child for his teeth. when ethan's mother, melissa saw the photo on instagram she was curious, alerted the day care center and the media. both the employee and the manager have since been fired for violating the kday care's privacy policy. in a statement the day care says a heavenly haven's position on the actions of the employees involved zero tolerance and the employees have been terminated. virginia's department of social services is now investigating.

joining us now on all of this is melissa jordan, her little son, ethan is the one you saw there at the top. melissa, thank you for joining us this morning. >> you're welcome. thanks for having me. >> now i hear ethan is there. i heard he's in a little bit of a mood. i got a toddler at home so i appreciate you just letting him do his thing because as we know you're not going to make them do whatever you want but tell us -- >> not going to happen. >> he's unaware of this at his age but you know what this is about all too well, yes? >> he's doing well. yes, he's unaware of what's going on because he's only 20. 2. >> it's got to hurt and i'm sorry. tell us how you found out about this? >> i found out through a mutual friend who happened to be instagram friends with her so she came upon the picture and said, this looks a lot like ethan, and she forwarded it to me and from there i was like wow, that looks a lot like ethan

and the outfit the little boy had on was what ethan wore to day care today. i was like wow this really is ethan and that's a how i fund out about it. >> putting your kid on instagram without your approval that's an obvious no-no but there's something deeper to talk about. ethan has delayed speech development, a lot of kids have that, they can grow into t get help, but you you put this kid into the care of these people and you see the photo online and how they're using it. what did it mean to you? >> it meant -- at my house we don't make fun of each other of our shortcomings, things that are out of our control and things that we -- things that we need extra help with we don't tease each other about. it was so foreign i figured they don't care about ethan. he's not important to them if they can do this to him and that's how i felt from that. >> that's your rule among family, those who have somewhat of a right to talk about each

other. here. >> exactly. >> this is one of the biggest fears i'd managimagine, you're putting your kid, day care, the big word is care in there. so what did it mean the people you were trusting with your child were acting this way? >> well, it just means to me that it wasn't somebody that i could trust and that they obviously don't love ethan and care for ethan anywhere near how i love ethan or care for ethan. >> do you think there's any good excuse for this? do you think that the day care center could come back and the people say it's a misunderstanding, you know, we love the kids, we were just being funny. do you think there's any of that here, any chance of that? >> that hasn't happened so i feel if they tried that, maybe i would be a little bit more understanding, like okay, it was an inappropriate joke. i'm not okay with it. there's no excuse for it but at

least i can understand the human error but that hasn't even happened. >> the place we're talking about, heavenly haven learning center two, they didn't want to do an interview with us. they put out the comment you heard in the piece there. have you heard from them? >> no. no one's reached out other than me -- when the incident first took place i took off work and i had a face-to-face with the director and other than that, there has been no contact. other than the contact i initiated. >> right and that was the right thing to do. there are other kids involved here. we have to make sure our kids are getting the best care possible especially by those supposedly trained and paid to do so. what is your message to the employees, to the day care center, what do you want them to know about how you feel? >> i want you to know that if you don't genuinely love and care for children and it's not a passion of yours, this isn't something you should be involved in. if you think it's funny that a child is delayed or if they're

an air tran flight had to be diverted to memphis last night after a passenger tried to open one of the plane's emergency exits mid flight. cnn's rene marsh is joining us with more. >> good morning, kate, i just got off the phone with the faa and they have confirmed with us this morning air tran flight 265 was the one that had to be diverted to memphis. it did land safely last night. local affiliates are reporting that the passenger who tried opening the emergency exit door was put into a police car and taken away. the plane with the passengers onboard then was able to take off and head to its final destination, which was austin, texas. it is worth noting that it is virtually impossible to open those exit doors while a plane is in flight, just simply because it is so pressurized within the cabin. the only way that that would be

possible is if for some reason the plane did lose pressure. but again, that is the status there. everyone onboard was able to get to their destination safely, kate. >> scary, scary trip and a pretty long delay i'm sure. thanks so much for the update, rene. >> whether you can do it or not, don't want people trying. that's for sure. we're going to head out west now, because fire crews are fighting the good fight there. some 49 wildfires raging right now in 11 western states. one of the worst, the beaver creek fire in central idaho. thousands had fled their homes. dan simon is live in haley, idaho, with the latest. dan? >> reporter: good morning, chris. with more than 100,000 acres burned, firefighters are using every resource at their disposal to get this under control. this fire is only 9% containment, with plenty of areas left to burn.

fire continuing to ravage one of the country's most scenic spots. a drive through the mountains and you can understand why many celebrities like tom hanks, arnold schwarzenegger and bruce willis chose this area to build vacation homes and why some insurance companies call in their own firefighters to help prevent a calamity. but as a red cross official told me -- >> many people think this is an affluent area, and it is, but many people are affected that are from different socioeconomic k backgrounds and that's who's staying with us. >> reporter: like this high school where we met orlanda. >> i think not knowing if we're going to have a home is the most nerve racking. >> reporter: the beaver creek fire is a true beast, surrounded by bone dry trees and brush, it's clear this fire could keep

burning a very long time. the key is to keep the flames away from homes, but the wind has a way of pushing the fire in different directions. >> we have plenty of resources right now and it's just a matter of having people at the right place at the right time, which i believe we do at this point in time. it's just a lot of work to go ahead and get this thing contained. >> well, rain is in the forecast and it could come as early as this evening, but with rain you have a mixed blessing that could produce thunderstorms and lightning and there's a concern that could ignite even more fires. kate? >> a long day ahead. dan, thank you so much. thousands of miles to the east, it's rain, not fire that's causing all the chaos. a stalled front threatening to soak everyone from the carolinas to the florida panhandle. anymore rain there could trigger flash floods. indra petersons has been tracking the weather. >> it will not let up. it's raining, what do you do, go to your apartment, want to hang

out. this is what happened in georgia, they go to their apartments and now they had rain go into the fair road apartments. their furniture was rolling around in the rain, their cars you can see the water level to the car doors. this is not the only place this is going on. take a look at the map. flood warnings stretching anywhere from the florida panhandle, all the way to the carolinas. where you see the bright green, that is flood warnings. that means it's imminent and already occurring in those areas. of course, more watches posted because even more rain is expected into the forecast. let's talk about what has been happening. look at the amount of rain since june. anywhere upwards from 20 to 30 inches of rain. how above normal is that? the southeast does get rain, but take a look. we're talking about ten to 15 inches above normal for this time of year and the stationary front is going to be staying in place, so we're going to be talking about two to three inches, four inches of rain

possible through thursday. that front is going to stay in place. no hope for now. >> all right, indra, thank you. let's move to the court marshal of major nidal hasan. he could testify at the end of his case. remember, he is representing himself in this court marshal. he's charged with murdering 13 and injuring 32. let's get to fort hood, texas, this morning. good morning, ed. >> reporter: good morning, kate. nidal hasan has already admitted he's the gunman. his assisting attorneys believe he's trying to get himself the death penalty. what will nidal hasan's defense strategy be? almost four years after the ft. hood massacre, nidal hasan will be center stage, expected to justify why he killed 13 fellow unarmed soldiers and injuring 32

others. >> if he testifies, which i suspect he will, to tell his story which essentially admits to the fundamental crimes and gives an excuse for doing so. >> reporter: for the victims' families, his testimony could be hard. in his view, they were preparing to fight muslims in afghanistan and iraq. since hasan is acting as his own attorney, he will write out a series of questions for his standby attorneys to ask him. >> a defendant, i believe, has a righting to -- we know he has the right to represent himself, and he has a right to do it poorly. and i think he has the right to ask for capital punishment. >> reporter: which leaves shooting survivors like christopher royal anxious for hasan to go away. >> i won't allow him to consume anymore energy from my life than he's already done. and so i have released him.

i've forgiven him, completely. and it's not up to me to punish him. >> reporter: and, chris, prosecutors only have a handful of witnesses left on their list. then it will be nidal hasan's turn and we're told right now he only has two witnesses on his list. whatever his defense strategy will be, it won't take long. >> thank you very much for the reporting now. moving on, new developments to tell you about in egypt this morning. the group's spiritual leader was arrested in cairo for inciting violence. now the obama administration has pulled the plug on some military aid to egypt. jill dougherty is live with that. good morning, jill. >> they are pulling the plug, but doing it very carefully. there's a reason. right now the administration is undertaking a major review, full

review of the aid that the united states gives to egypt. that, of course, is about $1.5 billion. what they are doing is not saying they are ending the aid. after all, the administration doesn't want to come down on either side at this point, so what they are doing is reprogramming while everything is under review. there's no decision, again, to permanently end it, but it avoids president obama having to take that step of saying is it a coup, isn't it a coup, which would then trigger a need, a legal necessity to end the aid. so again we're talking about $1.5 billion overall. most of that is in military aid. chris and kate? >> all right, jill, thank you very much for the reporting. a complicated situation, because you have such human causalities there and human rights issues on the ground, what you're going to do with the government, not easy to lead in these situations.

>> not easy to lead and a murky situation they've found themselves in. seems, obviously, a tough political situation they've got to get themselves out of. a lot of other news, as well. let's get right to michaela. >> let's do it. newly released court documents detail dzhokhar tsarnaev's injuries before his capture. a trauma surgeon testifying said tsarnaev had multiple gunshot wounds, including one through his mouth. tsarnaev has pleaded not guilty in the marathon bombings, which killed three people and wounded 260. james dimaggio left $112,000 in insurance money to hannah's grandmother. he named her as the policy's beneficiary. he was killed in the idaho wilderness. according to his sister, he wanted the money to go to hannah and her brother ethan because he thought the parents' relationship was too unstable to leave the money to them. a pop warner football league

will not let her son play because he is too fat. she says her son was crushed when it was revealed he was over the weight limit for his age. the head of the league said he never used the word fat and the child had to be banned for safety reasons. finally, yahoo! ceo controversy with this new photo shoot in vogue. she is reclining upsidedown in a lounge chair. some critics say it's not the image a woman in the corporate world should be presenting. supporters, however, argue being equal means a woman can be smart and feminine. >> exactly. >> she was laying the wrong way on the chair. does that count? >> he's got an engineering concern. >> that's what guys see. >> have you looked at magazine layouts? women don't usually pose like that. >> they can pose with their head on the right side of the chair.

welcome back to "new day," everybody. three more dolphins found washed up on beaches on the jersey shore this weekend and they are just the latest. it's a disturbing pattern that has marine biologists concerned and stumped. what do we know about this?

>> it is a mystery puzzling scientists all up and down the east coast. more than 200 coastal bottleneck dolphins have died and washed ashore in new jersey and virginia. scientists are trying to figure out what's happening. >> oh, look! look! >> it is a sight that tourists love to see. >> they like you. >> but this summer, a different scene is stunning beach goers. >> as we went by, it appeared to just be belly up, so it looked like it was not -- like it was a dead one. >> more than 200 dead bottleneck dolphins have washed ashore on the eastern seaboard from new york to virginia. officials at the virginia aquarium says their state sees an average of seven in july and august, but this year teams recovered 48 dead dolphins in july and 75 this month so far, including 25 just this weekend. >> 25 dolphins in one weekend is

something we can't handle. >> they are now working with noaa to investigate, collecting samples and noting similar ailments. >> we're seeing lesions in their respiratory system, a lot of them are thin. >> scientists are investigating a range of possible causes, from pollution to the return of a virus that killed more than 700 dolphins back in 1987. >> the fact they are dying from a number of different diseases may indicate there's an awful lot in the water we need to be concerned about. >> it is a mystery scientists hope to solve before the problem spreads. >> we have bike riders back here if you want to take a look. >> as they migrate south, we may see high fatalities in other states. >> now if you happen to see one of these stranded dolphins, do not touch it. noaa says stay away, call for help. they have a hot line, 866-755-6622. the reason this is even more of

>> he's alleged to have given certain advice to other defendants as part of an attempted coverup. >> reporter: police in nashville, tennessee, say boyd's teammates raped a 21-year-old student inside this campus dormitory in june. brandon branks, cory batey, and brandon vandenberg are all charged with rape and battery. >> that's pretty shocking. especially from vanderbilt. vanderbilt's such a good school as far as d-1 football. >> honestly, it's kind of sad. these are the guys we look up to. >> i don't think it's fair to take what happened in the past few weeks and pass that on to the rest of the team. >> the school noticed four football players acting suspiciously on a dorm surveillance video. >> we are shocked and saddened by the allegations that such an assault has taken place on our campus. >> reporter: authorities filed additional charges against two

welcome back to "new day." an amazing story of survival. seven people have been attacked by bears in five states in just less than a week. well, one of them is 12-year-old abby wetherell. abby was running in the woods near her grandparent's home in northern michigan. that's nothing unusual, but then a black bear attacked her, not once, but twice.

incredibly, abby survived and she's joining me now, along with her mother. a very thankful mother, relieved mother, i'm sure, elizabeth. it's great to see both of you. of course, of course, abby, first to you. how are you feeling this morning, i think that's what everyone cares about. >> i'm feeling okay. still in a lot of pain, but it will go away soon. >> it will go away. that's very much a good thing. kind of walk us through exactly what happened. you were jogging in the woods, you do that often. when did you know that you were in trouble? >> i knew i was in trouble when i saw the bear charging after me, because i knew i wasn't going to be able to outrun the bear. because it was far enough from my house and from my cabin that i couldn't run that fast, that far. it was just very terrifying, very scary. >> of course, it was. not only did the bear catch up to you and attack you once, the

bear went away a little bit, then you tried to run again and it attacked you twice. do you remember feeling anything or anything anything in particular when this was happening? >> i remember thinking i'm going to die, i'm not going to survive this. this bear's going to kill me. this is it. i'm a goner. and i couldn't really feel it. it was just my whole body was numb and it just really hurt. >> i was reading that at one point you even tried petting the bear to try to calm it down? >> yeah. the second time it kind of stopped by me and i was like, good bear. please, don't hurt me. that didn't work. >> elizabeth, your daughter really takes this entire experience in stride, but she needed 100 stitches and suffered some very deep cuts in her thighs, as well as in her back. what do you make of this entire

experience? obviously, first and foremost, just relieved that she's okay. >> oh, absolutely. you never want your children to hurt, and you want to protect them and keep them safe. you know, this is a run that she would do every single day in a place that she's familiar with. and for her to get hurt out there like that, it was absolutely the scariest thing i've ever experienced in my life. >> absolutely. >> me, too. >> that's for sure. abby, the thing that seemed to kind of save you in the end, you ended up playing dead. what made you think to do that in such an outrageous, you know, situation? >> i thought i had nothing else to lose. i mean, it might save my life, so why not do it? that's what i did. the bear ran away, then looked back, then ran away more and looked back. he just kept looking back at me. i'm thinking, oh, my gosh, this bear is going to come back and kill me. and then it just ran away.

that was good. >> so how did you end up -- the bear ended up going away. were you able to get up and make it back to the cabin, make it back to your family? how did it all end then? >> i got up and i started running to my house, which wasn't far, and then i saw one of my neighbors, her name is laura, and when i saw her face, i just thought everything is going to be fine. everything is going to be okay. i'm going to live. so it was all thanks to her. >> yeah, i mean, your wounds are healing. you've got amazing humor and perspective on this entire thing. are you going to be running in the woods any time soon? >> not alone, but i'll run on my road probably, yeah. >> elizabeth, what are the lessons learned here, i guess, or what are the lessons you're trying to teach elizabeth and your other daughter? >> well, the lesson for abby would be next time she's not

running by herself. i decided maybe i needed to pick up some jogging. i could lose a few pounds, it wouldn't be a bad thing. just to know where they are going at all times and really be careful and maybe take a phone with them when they run, something if something does happen they can get help quickly. >> abby, you look fabulous and we're so happy you're able to be here and tell us your story. what a story you have to tell now. have a good day. >> yes, she does. >> thank you, you, too. >> thank you. amazing. >> very lucky kid. >> yeah. >> very lucky kid. you know, what are you going to do, can't do anything differently. you want to run in the woods, run in the woods. >> not like she asked for a bear to come after her. >> usually black bears -- and i think it was a black bear. >> it is counterintuitive, the little i know about bears, it's counterintuitive how you should react if you can think about it when a black bear comes upon you, this is not the type of

bear you play dead for. you walk away slowly. you're not supposed to run. you're supposed to try to intimidate the bear. >> it's also counterintuitive to everything i learned growing up, they are generally more afraid of us than we are of them. this one aggressively pursued her, maybe because she was running. she seemed like prey or something. >> it's just a suggestion, not like they've sat down at some bear summit. the bear said, look, if you do this, we're not going to eat you. >> there's no bear summit? >> you catch your trails. you can carry bear spray, you know, if you're going to run in those situations, a lot of naturalists do, but the truth is you got to hope on luck and she got a lot of luck, this girl. more than most. >> how sweet is that she tried to pet the bear to try to calm it down? >> presence of mind to do that, i guarantee, your parents, you always love your kids but love them 105% when they've gotten lucky. hopefully, the silver lining,

that family is closer together than ever. >> sweet girl. not a bad segue. the adorable first photos of prince george have been released. this is a family very close together. close as they ever been, the newest british royal is four weeks old but is already making quite an impression. cnn royal correspondent max foster joining now with more, including a little hate for the photographer there. >> yeah. this was a big break in tradition. this was not a formal photo shoot. these weren't professional photographs. these were taken by some family member. a picture perfect family, william, kate, and little prince george, born less than a month ago. the first official photos of the royal bundle of joy released on monday by kensington palace. contrary to royal former babies of the past, these family photos were snapped by the baby's grandfather, michael middleton

in the backyard garden of the middleton family home in buc l bury. >> they've been going about it in a much more casual way. >> the proud parents look relaxed. kate beaming in a purple dress, while george sleeps comfortably, swaddled in her arms. a luxury occurrence according to prince william. >> he's growing quickly, he's a fighter, wriggles around a lot. >> in one photo, the family's four-legged friends join the fun, tilly, the middleton family retriev retriever, and lupo, t. the first official photos weren't without controversy. granddad's experience behind the lens is coming under question. the uk press criticizing the quality of the historic pictures, claiming the photos are very flat and there's not a great deal of contrast to them.

to waive confidentiality and allow evidence to go public. rodriguez faces a 211-game suspension for the use of performance-enhancing drugs. now he's firing back at both mlb and his team. jason carroll sat down with rodriguez's attorney monday. >> reporter: the drama playing out on the field, no match for the battle raging off the field. >> both the yankees and mlb never want alex rodriguez on the baseball field again. >> reporter: alex rodriguez's attorney says major league baseball and the yankees have been trying to sabotage rodriguez. he points to this mri and a written diagnosis provided to cnn from october of last year, which he says points to a tear in rodriguez's left hip. despite that tear, he says, rodriguez was cleared to play. >> now the amazing part of that is that was never shared with alex rodriguez at the time. >> reporter: major league baseball responded by saying mr.

tacopina continues to avoid the only relevant question, did rodriguez use performance-enhancing drugs, the rest of what he says is to distract people from the real issues. >> why is the rodriguez team not being as strong in coming out saying look, he did not use performance-enhancing drugs. >> you understand who some of these lawyers are. we're in the midst of some of the best lawyers in new york city. >> as an attorney you know it's a simple statement, my client did not use performance-enhancing drugs. >> because there is a confidentiality clause. >> reporter: there is a confidentiality agreement in place while rodriguez appeals his 211-game suspension. in a letter to tacopina, major league baseball is willing to waive those provisions of the confidentiality clause, saying tacopina is free to talk about information. mlb says it has evidence rodriguez used p.e.d.s, allegedly provided by the frmer

know, i thought about her all the time, i always thought about her, wondered what happened to her. i still have all of her pictures, because she was a part of our family. i don't know where she's been, who she's been with, or what she's been through. i just hope whoever had her gave her a good life. >> doggies are family in indiana, and this hurt for sure. that could be the good stuff right there, right? wrong. right after the shelter told jen they found sasha, they told her they'd euthanize the dog if jen couldn't get from indiana to phoenix in a couple days. jen had no way to make the trip, let alone on that amount of time, so that's when volunteers from the kindred hearts transportation connection stepped in, an organization made just for this purpose, to help reclaim dogs when they are too far away for you to get to them. they picked up sasha in time and volunteers drove sasha as far as they could go, all the way back to indiana. in all, it took 26 volunteers two weeks to get sasha back to a
